A recent investigation into 638 businesses in the farming industry has found that more than half of the businesses had underpaid workers, falsified pay records or failed to provide pay slips. Statistics like this highlight an increasing need for farm and agricultural businesses to establish and maintain compliance with workplace HR policies.
The investigation comes alongside a recent claim involving a NSW vineyard failing to pay a month’s worth of work to a labourer. Fair Work inspectors recovered more than $1 million in unpaid wages for more than 2500 workers during the investigation into businesses involved with harvesting crops such as grapes, strawberries, cherries, mushrooms, apples, citrus fruits and tomatoes. Some of the results of the investigation are as follows:
- 444 growers and 194 labour hire contractors were investigated with court action being taken against eight employers for serious alleged breaches of the Fair Work Act.
- Six of these matters have been finalised resulting in more than $500,000 in penalties while two are still before the courts.
- Inspectors also issued 150 formal cautions, 132 infringement notices, 13 compliance notices for breaches of workplace laws and entered into seven enforceable undertakings.
